PART I – INTRODUCTION
Rock Gate Capital, LLC (d/b/a InstaLeads and Truckers Network Association) respects yourprivacy. We have developed this privacy policy to advise you on how we collect, use, share, and protect your personal information. InstaLeads (“Company,” “we,” “us,” or “our”) uses thispolicy when a Visitor uses the InstaLeads website and mobile applications. We provide this
service to you (as described in the applicable Terms of Service), including through our website located at https://InstaLeads.com (the “Site”), and through related services (collectively, such services and Site, and any new features thereof the “Service(s)”). This Privacy Policy (the
“Privacy Policy”) also applies to digital subscriptions to any service or product of the Company, including, without limitation, mobile applications or other digital properties, (collectively with the Websites, the “Services”). Capitalized terms used herein but not defined shall have the meanings ascribed to them in the applicable Terms of Service.
To ensure that you fully understand your rights, you should be familiar with the following terms:
Deidentified Data – This is data we may collect that intentionally masks your identity. Because your identity has been removed, it is not possible to identify you from the records.
Anonymized Data – This is data that has been modified to remove or obscure any identifying information.
Analytics: A field of computer science that uses math, statistics, and machine learning to find meaningful patterns in data.
Opt-Out: This is your right to withdraw your consent to allow us to use your data in a certain manner.
Cross Contextual Advertising: Cross Contextual behavioral advertising is a type of advertising that targets consumers based on their personal information across different websites and apps.
Automated Decision-Making: This occurs when we have used your personal data to establish a profile. Based on that profile, we make business decisions.
“You” refers to the person assessing and using the services. You may be a “Platform User” if your employer provides you with access to the services or you otherwise use the Services under a service agreement with InstaLeads, an “employer” if you use the site to identify CDL holders for prospective employmenrt, and/or a site user when you browse the site generally (each a “User”.)
This Privacy Policy is incorporated into and forms part of the Terms of Service applicable to you. Before using the Services or submitting any Personal Data to Company, please review this
Privacy Policy carefully and contact us if you have any questions.
Your Consent to Our Privacy Policy
Any person accessing, browsing, or otherwise using the Services, either manually or via an automated device or program, shall be considered a “User”. All Users are bound by the terms of this Privacy Policy. Users consent to the collection, use, sharing, sale and disclosure of personally identifiable User information (“Information”) pursuant to the terms of this Privacy Policy.
What Is Considered Personal Information?
For our purposes, personal information is information that identifies, relates to, describes, refers to, or could be associated or reasonably linked to you.
Information We Collect from Your Interactions with Us
We collect information that you provide, or we receive from other sources. This may include
Personal Information (PI) or Sensitive Personal Information (SPI) that you provide when you use the Services, on third-party websites, applications when subscribing to our Services, and through requesting certain InstaLeads services or products.

In addition, we may collect, use, and disclose your Personal Information as required or permitted by law. Please recognize that we do not safeguard deidentified data (data that hides your identity) or aggregated consumer information like we do Personal Information, and we reserve the right to convert, or permit others to convert, your Personal Information into deidentified data or aggregate information.
For purposes of this Privacy Policy, “Sensitive Personal Information (SPI)” means any information that reveals (a) your Social Security Number or other type of identification number;
(b) your account log-in, debit card or credit card, or any required security or access code; (c) your geolocation; (d) your racial or ethnic origin religious or philosophical beliefs, or union membership; (e) the contents of your mail, email, or text messages, unless our business is the intended recipient of those communications; and (f) your genetic data.
Although it is our preference to minimize the collection of Sensitive Personal Information, it is possible that we have collected, within the past 12 months, the categories of Sensitive Personal Information about consumers that are listed in the chart below. The Sensitive Personal Information we collect varies depending on the nature of your interactions with us and may not be listed below.

Information You Provide: Personal Information may be obtained directly from you. If you submit Personal Information to use about someone else, then you represent that you are authorized to provide their personal information to us, and that person has consented to have us use their personal information in accordance with our Privacy Policy.
Information Collected Automatically: We may use various tools and technologies, like cookies and web server logs, to collect information automatically. This information may include IP addresses, device identifiers, browser characteristics, operating system details, internet service provider details, language preferences, referring URLs, time and length of visits, and pages viewed.
Information Collected from Other Parties
Personal Information may also be secured from other parties who are authorized to provide the information, from activity on our Services, and from other parties with whom we work, such as service providers, business partners, advertisers, advertising related technology providers, advertising servers, data analytics providers, and social networks. For example, if you choose to link your social media or other third-party accounts to our Services, we may obtain your Personal Information from those platforms.

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use the Site and enhance your experience when you use the Site. PART II – HOW WE USE YOUR PERSONAL DATA

Anonymized and Aggregated Information
We may anonymize Personal Data, and separate your Score or other results from your Assessment from information that could be used to identify you (as a Visitor), aggregate such data with other similar data and use the anonymized and/or aggregated information to analyze the effectiveness of our Service, to improve and add features to our Service, and for other business purposes, and we may share such anonymized and/or aggregated information. In addition, from time to time, we may analyze the general behavior and characteristics of users of our Services and share aggregated information like general user statistics with prospective business partners. We may collect anonymized information, including system information, through the Service, through cookies, and through other means described in this Privacy Policy.
Marketing
We may use your Personal Data to contact you to tell you about products or services we believe may be of interest to you. For instance, if you elect to provide your email or telephone number, we may use that information to send you special offers. You may opt out of receiving emails by following the instructions contained in each promotional email we send you. You can also control the marketing emails and/or text messages you receive by updating your settings through your account. In addition, if at any time you do not wish to receive future marketing communications, you may contact us info@truckersnetwork.com . If you unsubscribe from our marketing lists, you will no longer receive marketing communications, but we will continue to contact you regarding other administrative matters and to respond to your requests.
Sharing and Disclosure of Your Personal Data
In certain circumstances we may share your Personal Data with third parties without further notice to you, unless required by the law, as set forth below:
Vendors and Service Providers
To assist us in meeting business operations needs and to perform certain services and functions, we may share Personal Data with vendors and service providers, including providers of hosting services, cloud services and other information technology services providers, event management services, email communication software and email newsletter services, advertising and marketing services, payment processors, customer relationship management and customer support services, and web analytics services. Pursuant to our instructions, these parties will access, process or store Personal Data in the course of performing their duties to us. We take commercially reasonable steps to ensure our service providers adhere to the security standards we apply to your Personal Data.
Business Transfers
If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of service to another provider, your Personal Data and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor or affiliate as part of that transaction along with other assets.
Legal Requirements
If required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation, including to meet national security or law enforcement requirements, (ii) protect and defend our rights or property, (iii) prevent fraud, (iv) act in urgent circumstances to protect the personal safety of users of the Services, or the public, or (v) protect against legal liability.
Affiliates
We may share Personal Data with our affiliates, meaning an entity that controls, is controlled by, or is under common control with Company. Our affiliates may use the Personal Data we share in a manner consistent with this Privacy Policy.
Text Messages
If you provide your mobile phone number to us, we may ask for your consent to receive text message alerts from us containing product/service, event, or promotional information in a text or SMS message (“Text Messages”). The Text Message program allows users to receive SMS/MMS mobile messages by users affirmatively opting into the program. Your consent to receive Text Messages is not required to purchase services from us.
PART II – RETENTION OF YOUR PERSONAL DATA
We keep Personal Data for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a business interest in retaining your data, or as required by law (e.g., for tax, legal, accounting or other purposes), whichever period is longer.
Your Choices About How We Handle Your Information
In order to allow you to make informed decisions about how we handle your information, we provide the following means to allow you control over your information.
- Marketing Related Communications: By using the “Unsubscribe” feature at the bottom of each email or “STOP” in text messages, you can prevent receiving future solicitations from us.

Our Service is not designed to communicate with individuals who are under the age of 18. Our Company does not knowingly collect Personal Data from children under the age of 13. Links to Other Websites
The Service may contain links to other websites not operated or controlled by Company, including social media services (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third- Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third-Party Sites directly for information on their privacy practices and policies.
How We Keep Your Personal Data Safe
Please recognize that you use the Service at your own risk. We implement commercially reasonable technical, administrative, and organizational measures to protect Personal Data both online and offline from loss, misuse, and unauthorized access, disclosure, alteration or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. E- mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or e-mail. Please keep this in mind when disclosing any Personal Data to Company via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third – party websites.
Your Choices Regarding Personal Data
In certain circumstances providing Personal Data is optional. However, if you choose not to provide Personal Data that is needed to use some features of our Service, you may be unable to use those features. Changes to Our Privacy Policy
The Service, and our business may change from time to time. As a result, we may change this Privacy Policy at any time. When we do, we will post an updated version on this page, unless another type of notice is required by the applicable law. By continuing to use the Service or providing us with Personal Data after we have posted an updated Privacy Policy, or notified you by other means if applicable, you consent to the revised Privacy Policy and practices described in it.
PART III – PRIVACY RIGHTS GRANTED BY MULTIPLE STATES
Certain states have passed legislation to provide their residents with additional rights. These states include California, (California Consumer Privacy Act “CCPA”), Iowa, (Iowa Consumer Data Privacy Act “ICDPA”), Nebraska, (Nebraska Data Privacy Act (“NDPA”) and Texas, (Texas Data Privacy and Security Act (“TDPSA”). In the event of a conflict between the Privacy Policy stated above and these provisions, these specific provisions will control for residents of California and Texas.
An Explanation of Your States Privacy Right
With some limited exceptions, residents of California, Iowa, Nebraska, and Texas may enjoy the following additional privacy rights:
The Right to Know or Access Your Personal Information
You have the right to know if we are processing your personal information and to access the personal information, we are handling.

Your Right to Delete Your Personal Information
You have the right to request that we delete the personal information we have gathered about you. If you ask us to delete your personal information, we will delete it. We will also ask our service providers to delete your personal information.

You have the right to correct any personal information we have retained about you if it is incorrect. It may be necessary for you to provide additional documentation to establish that the information we have retained is inaccurate.
Your Right to Advise Us Not to Share or Sell Your Personal Information
If you reside in California or Iowa, you may notify us that you do not want us to share or sell your personal information and we will allow you to “opt out.”
If you reside in Texas or Nebraska, you may “opt out” of the sale or sharing of your personal information when the personal information is used as targeted advertising; for sale; to conduct automated profiling when that type of profiling could lead to legal conclusions that are unwelcome (e.g. denial of employment).
PART IV – OUR COMPLIANCE WITH STATE SPECIFIC STATUTORY RIGHTS
California Privacy Rights
We comply with the “Shine the Light” law and meet the corresponding requirements.
First, we would advise you, free of charge, if we disclosed in the previous calendar year the information described below to third parties for direct marketing purposes: your name and address, including any email addresses, information about children: name, age, date of birth, gender, how many children you have, physical information such as your height, weight, race, medical conditions, drugs or therapies used, financial information such as credit card, debit card, or bank account number, investment history, lifestyle information such as political party affiliation, education level, religion.
We also agree to provide you with the name and address of third parties that received any of your personal information, and the category of your personal information received by the third party.
All of our employees or contractors who interface with you will offer you the address you can use to contact us. info@truckersnetwork.com. If you communicate with us in another way, we will promptly respond to your request. Please note, however, there may be a delay in our response if you do not direct your inquiry to our designated email address.
Collection, Disclosure, and Use of Personal Data
The categories of Personal Data we have collected in the preceding twelve months are described above in the “ Information We Collect ” section. In the preceding twelve months, we have disclosed for business purposes each of the categories identified in that section to the third parties identified in the “ How We Use Your Personal Data ” section. The business and commercial purposes for collecting Personal Data are described in the “How We Use Your Personal Data” section. We collect Personal Data directly from you and from your use of our Service.
Verification
In order to protect your Personal Data from unauthorized access or deletion, we may require you to verify your login credentials (to the extent you have created an account to use the Services) or by other means before you can submit a request to understand our use or delete your Personal Data. If you do not have an account with us, or if we suspect fraudulent or malicious activity, we may ask you to provide additional Personal Data to allow us to verify your identity. If we cannot verify your identity, we will not provide or delete your Personal Data.
Authorized Agents
You may submit a request to know or a request to delete your Personal Data through an authorized agent. If you do so, the agent must present signed written permission to act on your behalf and you may also be required to independently verify your identity with us.

California Residents’ Additional Rights – Right to Limit the Use of Personal Information
California created a new category of personal information called Sensitive Personal Information (SPI) which includes:
- Heritage: Racial origin and ethnicity
- Personal Characteristics: Religious beliefs and political and philosophical convictions
- Sexual Data: Sexual orientation and sex life activity
- Personal Communications: Contents of user’s mail, email, and/or text messages
- Health and medical status history
- Precise geolocation
- Genetics and biometrics
- Government Identifiers -Social Security and driver license numbers
- Financial Information: – Account log-in, financial account, debit card, or credit card number, along with any required security codes, passwords, or
For Californians, they have the right to request a business limit the use of their SPI to “only that which is necessary to perform the services of provide the goods reasonably expected by an average consumer who requests such goods or services.”
To comply, Companies must publish a second website homepage link labeled, “Limit the Use of My Sensitive Personal Information.” This allows California residents to exercise their rights including opting out of the use, sale or sharing of their SPI.
In addition to these rights, Californians can also request the disclosure of what SPI is collected, how it is used and the duration of use.
Right to Receive a Copy of Your Personal Data in a Manageable Format
You may request a copy of your personal information be sent to you in a manageable format.
Right to Exercise Your State Rights Without Being Treated Unfairly
You may exercise the rights enumerated above without fear of being targeted or treated differently than others who have their personal information collected by us.
California residents may exercise four additional rights 1) Right to Correct; 2) Right to Know; 3) Right to Delete; and 4) Right to Opt Out.
- Right to Correct – If you believe that the Personal Information or Sensitive Personal Information, we have collected about you is incorrect, you have the right to request that we correct your information.

You have the right to opt out of our sale of your Personal Information and Sensitive Personal Information, and to request that we do not share your Personal Information and Sensitive Personal Information for “cross-context behavioral advertising.” Cross Contextual behavioral advertising is a type of advertising that targets consumers based on their personal information across different websites and apps.
To opt-out, please contact us using at info@truckersnetwork.com. Opting-out of the sale of your information for certain types of interest-based advertising does not preclude you from seeing those ads. That is especially true if we shared your information that was collected prior to 90 days before we received your opt-out request.

Your Right to Limit Use and Disclosure of Your Sensitive Personal Information. We do not use or disclose your Sensitive Personal Information in any way inconsistent with your right to limit use and disclosure as applied under the CCPA and CPRA.
Rights Related to Automated Decision-Making. You have the right to opt out of automated decision-making. Automated decision making often includes profiling. We use this profiling function to evaluate your personal characteristics relating to your work, economic situation, health, preferences, curiosities, trustworthiness, behavior, location, and/or movement.
Right to Non-Discrimination if You Exercise of Your Privacy Rights. If you choose to exercise any of your privacy rights under the CCPA and CPRA, you have the right not to be discriminated by us in any way.
You may use an authorized agent to submit your requests. We do not discriminate against a user if they exercise any of the rights available under the CCPA or CPRA. If you do exercise your rights under CCPA or CPRA, we may charge a different price or rate or offer a different level or quality of good or service. We only vary the price, rate or quality, however, if doing so is reasonably related to the value of your data and permitted under the law. In addition, we may offer you financial incentives for the collection, sale and retention and use of your Personal Information and Sensitive Personal Information, consistent with the CCPA and CPRA that could result in reasonably different prices, rates, or quality levels. The significant aspects of any financial incentive offered to you will be explained and described in our program terms. Your participation in any of our incentive programs is entirely optional. You will have to affirmatively “opt-in” to the program. You can also “opt-out” of each program (i.e., end your participation and decline the ongoing incentives). To do so you will need to follow the instructions in the program description and program terms. By posting notice on the program descriptions and terms, we may add or change our incentive programs. You will need to check them regularly. We cannot fulfill a request, pursuant to CCPA or CPRA, unless you have provided enough information for us to reasonably verify you are the consumer about whom we collected
Personal Information and/or Sensitive Personal Information. We will typically not charge a fee to fully respond to your requests, but we may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.
We do not sell the Personal Information and Sensitive Personal Information of consumers if we know the consumer is less than 16 years of age, unless we receive affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to Personal Information or Sensitive Personal Information sales may opt-out of future sales at any time.
Job Applicants
Although CCPA and CPRA rights do apply to Personal Information collected from job applicants and current employees, the instant policy only covers applicants and employees in their capacity as users of our website. Separate privacy disclosures apply to these parties during their application and onboarding processes.
Your Nevada Privacy Rights
Nevada provides its residents with a limited right to opt-out of certain personal information sales. Nevada residents who wish to exercise their sale opt-out rights under Nevada Revised Statutes Chapter 603A may submit a request to info@truckersnetwork.com.
Your Colorado, Connecticut, and Utah Privacy Rights
Colorado, Connecticut, Virginia, and Utah all provide their residents with rights to:
